Terms of Service
1. Agreement & Professional Relationship
By scheduling or utilizing services provided by Blessing Hands Mobile Services (“Company,” “we,” “our,” or “us”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. You further acknowledge that the Company operates as an Independent Contractor and that no agency, partnership, joint venture, or employee-employer relationship is intended or created by these Terms.
2. Scope of Clinical Support Services
The Company provides mobile clinical support specifically limited to:
- 🔹 Mobile Blood & Specimen Collection
- 🔹 EKG Testing (Collection Only)
- 🔹 Vital Signs Monitoring
- 🔹 Specimen Transport to Licensed Labs
CRITICAL: We do NOT diagnose, treat, or provide medical advice. All testing is performed under valid physician orders.
3. Hand-off & Lab Liability Disclaimer
- Laboratory processing errors or delays.
- Lost or compromised samples within the laboratory facility.
- Inaccurate results generated by the diagnostic facility.
- Delayed reporting of results to the ordering physician.
4. Indemnification Clause
You agree to indemnify, defend, and hold harmless Blessing Hands Mobile Services, its owners, and staff from and against any and all claims, damages, or expenses (including attorney fees) arising from: (a) your provision of inaccurate medical or insurance information; (b) your failure to follow clinical preparation instructions; or (c) any adverse reaction standard to clinical procedures not caused by gross negligence.
5. Logistics & Service Environment
You are responsible for:
- Safe clinician entry and accessible parking at the service location.
- Confirming presence of a responsible adult for minors or incapacitated patients.
- Providing a clean, well-lit area for specimen collection.
6. Financial Policy & No-Refunds
All convenience fees and service charges are non-refundable once the clinician has arrived at the location, regardless of whether a collection was successfully completed (e.g., patient refusal or dehydration). We do not guarantee insurance coverage or reimbursement.
Late Cancellation Fee:
Cancellations with less than 24-hours notice will incur the full service fee.
7. HIPAA & PHI Protection
We strictly adhere to HIPAA regulations. Your Personal Health Information (PHI) is transmitted only via encrypted channels to your clinician and the diagnostic laboratory. Any PII/PHI submitted via public forms is done so at the user's own risk.
8. Force Majeure & Limitation of Liability
Blessing Hands shall not be liable for failure to perform due to circumstances beyond our control, including but not limited to: extreme weather, state of emergencies, traffic accidents, or infrastructure failure. In no event shall our total liability exceed the total fee paid for the specific service rendered.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the **Commonwealth of Pennsylvania**. Any dispute arising from these services shall be resolved exclusively in the courts located in Pennsylvania.
